Lifetime Materials Warranty

[Gutter Grip] warrants that its premium gutter protection system will be free from material and manufacturing defects, under normal use and maintance, for as long as you reside in the building or structure of the original installation. If the gutter protection system covered by this warranty is defective, [Gutter Grip] will repair or replace the defective part(s). [Gutter Grip] will provide the repair or replacement part(s) free of charge; except otherwise provided herein.

20-year Paint Performance

[Gutter Grip] warrants that [Gutter Grip] Top Caps and End Caps with the Kynar 500 paint finish will not crack, rust, peel or blister for 20 years from the date of installation.

Lifetime Performance Warranty

[Gutter Grip] warrants that its premium gutter protection system will keep gutters free flowing, subject to the exceptions, limitations, and other terms and conditions found in these warranties. When correctly installed, [Gutter Grip] products are specifically designed to transport water into the gutter system, while keeping clogging debris out.

Limitations

The warranty only covers defects in manufacturing or materials specified herein. This warranty does not cover any damage to the system caused by the owner(s) home or any damage caused by events beyond the control of [Gutter Grip] including but not limited to: fire, flood, lightning, vandalism, misuse, abuse, chemical pollutants, earthquakes, excessively high winds, windblown objects, hail damage, tree damage, ice damage, insect or animal infestations, mold or other biological infestation, failure of the underlying structure of the home or of any existing gutters on the home, or other Acts of God. Modifying or tampering with an installed [Gutter Grip] system by any unauthorized person will void these warranties.

Initial 30-Day Weathering Period

Testing the [Gutter Grip] system with a garden hose will not replicate an actual rainstorm. The Kynar 500 finish on your [Gutter Grip] Top Cap needs to be outside on your gutter to weather for a period of no less than 30 days after installation. This establishes a change in the surface of the finish so that water will adhere as designed.

Claims Procedure

To obtain warranty service, contact your [Gutter Grip] dealer. Please provide the date of purchase information from the gutter protection system in question. In the event of such repair or replacement, the remaining warranty period of the original warranty shall apply to the replacement part. If no warranty period remains, the new part shall be warranted for 12 months. If [Gutter Grip] no longer manufactures the identical part or component, [Gutter Grip] reserves at its option, the right to substitute a part or component of equal value as a replacement.

[GUTTER GRIP] MAKES NO OTHER WARRANTY OR REPRESENTATION OF ANY KIND WHATSOEVER EXPRESSED OR IMPLIED, AND ALL IMPLIED WARRANTIES INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.

The parties hereto irrevocably waive any right to trial by jury in any action or proceeding to enforce or defend any rights under or in connection with this guaranty or arising from any dispute or controversy in connection or related to this guaranty and we agree that any such action or proceeding shall be tried before a court and not before a jury.

Any action brought to enforce the terms of this guaranty shall be in a court having its situs in the city of Chicago, county of Cook, and state of Illinois.

[Gutter Grip's] maximum liability hereunder is limited to the current wholesale price of the defective gutter protection system. In no event shall [Gutter Grip] be liable for any consequential, indirect, incidental or special damages of any nature arising from the sale or use of such gutter protection system in contract, tort, strict liability or otherwise. No change, written or verbal, in this Warranty is authorized by [Gutter Grip].

This Warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
